Terms of Use & End User License Agreement

Welcome to Decibel Meter & dB Sound Level (the "App"), a mobile application developed and operated by Appcellent Yazılım Hizmetleri Anonim Şirketi ("Company", "we", "us", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
1. Acknowledgment of Apple App Store Terms
The App is licensed, not sold, to you. It is distributed through the Apple App Store, and your use of it is also subject to Apple's Media Services Terms and Conditions, including the standard End User License Agreement for licensed applications, which can be viewed here: https://www.apple.com/legal/internet-services/itunes/
In the event of any conflict between this document and the Apple Media Services Terms, this document prevails specifically with regard to the measurement accuracy disclaimers set out below.
2. Measurement Accuracy Disclaimer (Important)
PLEASE READ CAREFULLY: The App estimates sound pressure levels using the microphone built into your device. Those microphones are designed for voice calls and video, not for acoustic metrology. The App is intended for informational and educational purposes only.
- Not a certified sound level meter: The App is not a Class 1 or Class 2 sound level meter as defined by IEC 61672, and it is not calibrated, certified or traceable to any national standard. Readings are approximations.
- Device dependent: Accuracy varies with your device model, its microphone placement, your case, wind, humidity, and how you hold the phone. Very quiet and very loud environments are the least reliable, because phone microphones compress and clip loud sounds.
- Not for compliance or legal use: Readings, noise dose figures and exported reports must not be used as evidence of compliance with occupational noise regulations (such as OSHA or NIOSH limits), environmental noise ordinances, tenancy disputes, insurance claims, or any other legal or regulatory purpose. Where a formal measurement is required, use certified equipment operated by a qualified professional.
- Not medical advice: The noise dose indicator and the reference table are general guidance based on published exposure limits. They are not a diagnosis, a hearing test, or a substitute for advice from a physician or audiologist. If you are concerned about your hearing, consult a healthcare professional.
- Calibration is your responsibility: The App lets you apply a manual correction against a reference meter. Any correction you enter is your own, and we make no representation that it makes subsequent readings accurate.
You assume full responsibility for any decision you make based on readings from the App. Appcellent Yazılım Hizmetleri Anonim Şirketi shall not be liable for any hearing damage, personal injury, property damage, regulatory penalty or financial loss resulting from reliance on the App.
3. Permissions You Grant
The App asks for the microphone in order to measure sound, and optionally for the camera (to overlay the readout on a live image and record clips) and your location (to label saved measurements with where they were taken). You may decline or withdraw any of these at any time in your device settings; the microphone is the only one the core measuring feature requires. How this data is handled is described in our Privacy Policy.
4. Acceptable Use
You agree to use the App lawfully and considerately. In particular, you agree not to use the App or its camera mode to record people without their knowledge or consent where doing so is unlawful in your jurisdiction, and to comply with all applicable recording, privacy and workplace laws. You are solely responsible for any content you capture and share.
5. Subscriptions and Payments
The App offers optional auto-renewable subscriptions that unlock its premium features.
- Plans: a weekly plan, which begins with a free trial period, and an annual plan. The exact duration, price in your local currency and trial length are always shown on the purchase screen inside the App before you confirm.
- Billing: payment is charged to your Apple ID account at confirmation of purchase, and is processed by Apple. We do not receive or store payment card information.
- Free trial: if you start a plan with a free trial and you do not cancel before the trial ends, the subscription converts to a paid subscription automatically and the first period is charged. Any unused portion of a free trial is forfeited if you purchase a subscription before the trial ends.
- Renewal: subscriptions renew automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of that period.
- Managing and cancelling: you can manage or cancel your subscription at any time in Settings > your Apple ID > Subscriptions on your device. Deleting the App does not cancel a subscription.
- Refunds: purchases are handled by Apple, so refund requests are decided by Apple under its own policy, at reportaproblem.apple.com. We cannot issue refunds directly.
- Restoring: if you reinstall the App or change device, use "Restore Purchases" in the App's Settings to recover an active subscription.
- Price changes: we may change subscription prices. Apple will notify you and ask for your consent before any increased price applies to your renewal.
6. Your Content
Measurements, recordings and clips you create with the App are yours. They are stored on your device; we do not claim any ownership of them and have no access to them. You are responsible for backing them up — uninstalling the App or deleting a record removes the underlying files permanently.
7. Intellectual Property
The App, including its code, design, interface, and graphics, is the proprietary property of Appcellent Yazılım Hizmetleri Anonim Şirketi and is protected by international copyright and trademark laws. You may not reverse engineer, decompile, or attempt to extract the source code of the App.
8. Third-Party Services
The App relies on third-party services, including Apple for distribution and payments, RevenueCat for subscription management, and Mixpanel for anonymous usage analytics. We have no control over, and assume no responsibility for, the practices of third parties beyond our agreements with them.
9. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any reading it produces is accurate.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the App. Where liability cannot be excluded, it is limited to the amount you paid us for the App in the twelve months preceding the claim.
11. Termination
These Terms remain in effect until terminated. You may terminate them at any time by deleting the App. We may suspend or terminate your access if you breach these Terms. Sections 2, 7, 9, 10 and 12 survive termination.
12. Governing Law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law principles, and the courts of Istanbul shall have jurisdiction. This does not deprive you of any mandatory consumer protection rights available to you under the law of your country of residence.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of changes by posting the new Terms on this page and updating the "Effective Date" above. Continued use of the App after a change constitutes acceptance of the revised Terms.
